Judge dismisses lawsuit over neighborhood threatened by sinkholes

A judge is dismissing a lawsuit brought by a group of western South Dakota homeowners over sinkholes endangering their homes.

Dozens of neighbors in the Hideaway Hills in the community of Black Hawk sued the state after sinkholes began appearing in their neighborhood in 2020.

They argue the sinkholes are caused by an old state-owned mine the homes were built on top of. They say the state failed to disclose the property's condition when it was sold.

Judge Eric Strawn on Wednesday granted the state’s motion for summary judgement, ruling the state has sovereign immunity.

The Associated Press reports the homeowners plan to appeal the decision to the South Dakota Supreme Court.
