The trial for the man charged in the death of a South Dakota deputy is being moved back.
Authorities say Joseph Hoek killed Moody County sheriff’s deputy Ken Prorok during a pursuit in February of 2024.
According to Attorney General Marty Jackley, Hoek led law enforcement on a pursuit during which he reached speeds of 115 miles per hour. Prorock deployed spikes on Highway 34 in an effort to end the chase. A witness said Hoek swerved and struck Prorock.
Hoek pleaded not guilty to first-degree murder and aggravated eluding charges. His trial was set to begin in May, but on Thursday his attorney asked the judge to delay it to allow more time to prepare his defense.
Jackley objected to the motion, but the judge granted the request. The trial is now set for Oct. 14.
The state plans to pursue the death penalty in the case, Jackley said.
