The House Judiciary Committee passed a measure that provides judicial review of Board of Regents decisions involving student discipline and residency classification. Republican Representative Charles Hoffman says this bill cleans up the current legislation known as the Administrative Procedures Act. In it some students are exempt from residency tuition and HB 1021 removes the exemption.
"In good faith, I believe the Board of Regents felt that in some of their hard ship cases, where there is a student who has not been granted resident status, we did not allow that student to take it all the way into circuit court. This is permitting them to take that hard ship case all the way, if the care to, to the state supreme court, which we believe is in the best interest of all of us who are trying to abide by the rule of law," Representative Hoffman says.
Hoffman says this bill grants more judicial rights to students in a way that hasn’t been done before. House Bill 1021 goes next to the house floor.
