Officials with the City of Sioux Falls are suing a contractor over outside panels on the newly-constructed events center. The Denny Sanford PREMIER Center opened one year ago, and metal siding showed rippling not long after. Leaders say they tried to settle with contractors, but now they turn to the courts to resolve the problem.
City Attorney Dave Pfeifle says contract documents between construction companies and the city of Sioux Falls allowed stakeholders to negotiate a fix for bulging metal siding on the new events center.
"The informal resolution process has led to results led to agreement on the settlement terms by all the parties. Settlement documents were drafted and approved by all the parties; however, now one of the parties has refused to execute the settlement documents," Pfeifle says. "The City of Sioux Falls is joining with Mortenson, Sink Combs Dethlefs, Koch Hazard, and IMETCO to commence litigation against MJ Dalsin Incorportated to enforce the terms of the settlement agreement."
Pfeifle says the contractors and the city willingly struck the deal in May. The city attorney says the litigation is targeted at MJ Dalsin and the other contractors mentioned have actively worked to resolve the siding problem.
Pfeifle says city leaders respect the judicial process and are allowing the courts to decide.
MJ Dalsin company leaders did not return calls for comment from South Dakota Public Broadcasting.
