Breonna Taylor's Case With Dean Fulton

SDPB

In The Moment … September 25, 2020 Show 910 Hour 2

A grand jury in Kentucky declined to indict officers who shot and killed Breonna Taylor in her home in March. Officers were issuing a warrant. When officers broke down the apartment door, Breonna's boyfriend thought they were being attacked by intruders. He shot at officers, striking one. Officers returned fire, killing Breonna Taylor.

Those are the basics of a complicated case. It's a case that has many declaring justice for Breonna Taylor. What does the law say? And what does the law say in South Dakota? Because as South Dakotans tune in to the national news, many are asking: Could a case like this happen here ... in a state where many homeowners and apartment-dwellers own guns.

Neil Fulton is Dean of the USD School of Law.
