The Senate Judiciary Committee is advancing a bill that proponents say strengthens 2nd Amendment Rights in the state for land buyers.
HB 1080 specifically voids covenants attached to land from prohibiting or restricting firearm and ammunition use and possession.
District 1 Republican Sen. Mike Rohl is the bill’s prime sponsor. He said it’s a follow up from a bill in the 2024 legislative session.
“Last year there was an issue with an HOA, it wasn’t in the state, it was outside the state, that was banning guns. We did that proactively," Rohl said. "During that process it came to light that these covenants do exist West River dating back to the 1900s in a lot of cases. That’s why the original intent of the bill was actually to break those. We hit a roadblock with that on the House side, so we figured it’s at least better to at least stop them going forward."
The bill passes committee unopposed and heads to the Senate floor.
