The Eighth Circuit Court of Appeals heard arguments on Wednesday, Jan. 12, in South Dakota ’s ongoing battle to shoot off fireworks at Mount Rushmore for Independence Day. The state says the National Park Service wrongly denied a 2021 permit after a successful event the year before. But the feds say every year brings its own set of circumstances to be considered, and so each permit needs to be studied.

Defense lawyers say charges against Nick Tilsen should be dropped after the prosecutor wrote a letter with negative comments that was sent to possible witnesses. The prosecutor says the comments are irrelevant to Tilsen's charges.

Last month, the four faces of Mt. Rushmore had some company. A specialized rope team rappelled down the sculpture to track wear-and-tear on the state's most famous attraction.

The Rope Access Team recently rappelled down Mount Rushmore to calibrate sensors that monitor "rock blocks" in the granite.
